Terms of Service

These Terms of Service ("Terms") are an agreement between you and SwingRotation LLC ("SwingRotation") governing your use of swingrotation.com and our golf training-aid rental service. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for the accuracy of your account and shipping information, and for activity under your account.
• Keep your credentials confidential. Notify us promptly of any unauthorized use.
• One person per account; accounts are non-transferable.

SwingRotation offers subscription plans (currently Basic at $35/month, Plus at $55/month, and Pro at $75/month). Each plan states the maximum number of training aids you may have out at one time — 1 on Basic, 2 on Plus, 3 on Pro — and the number of rotations included per month: 1 on Basic, 2 on Plus, 3 on Pro.

• Rotations — a rotation (exchange) is one replacement shipment, regardless of how many items it contains. Rotations are counted per month, and unused rotations do not roll over to the next month.
• Shipping — your first rotation or return each month ships free. Additional rotations and returns in the same month are billed at our shipping cost.
• Billing — when payments are enabled, plans renew automatically each cycle at the then-current price until canceled. You may cancel at any time; cancellation takes effect at the end of the current cycle, and rented aids must still be returned under the rental terms below.
• Founding launch period — during our founding member launch, plan billing may not yet be enabled. Until payments are enabled, no charges are made, and features that require payment (including completing Keep It purchases) remain pending. We will notify members before billing begins.
• Plan changes — we may change plan prices or allowances with notice before your next renewal; changes do not apply mid-cycle.

• Rented training aids remain the property of SwingRotation at all times.
• Use aids only as intended by their manufacturers, and follow all included instructions and safety guidance. You are responsible for any injury or damage arising from misuse.
• Keep aids in good condition. Normal wear from proper use is expected and is not charged.
• Return each aid by its due date using the return method we provide. Late returns may limit your ability to rent or exchange until the aid is back.
• Lost, stolen, or damaged aids — tell us promptly. You may be charged the aid's listed Keep It price (or repair cost, if lower) for aids that are lost, stolen, or damaged beyond normal wear while in your care.
• Do not sell, lend, or move rented aids to a third party, or use them commercially without our written permission.

To exchange, request a replacement aid through your account; we ship the replacement and provide a return method for the outgoing aid. The outgoing aid must be shipped back promptly using that method. Each completed exchange request counts as one rotation against your plan's monthly allowance, as described above. Your first rotation or return each month ships free; additional rotations and returns in the same month are billed at our shipping cost.

• Any aid you are renting may be purchased at its listed Keep It price, which buys the exact unit you have.
• Starting a Keep It purchase creates a pending purchase. The purchase completes when payment is successfully processed; at completion, ownership of that unit transfers to you and the rental closes.
• During the founding launch period (payments not yet enabled), Keep It purchases stay pending and no charge is made.
• Completed Keep It purchases are final, except where a unit arrives materially not as described, in which case contact us and we will make it right.

If you upload swing videos or other content, you keep ownership of it and grant SwingRotation a license to store, process, and display it back to you solely to provide the service (including swing analysis, when enabled). Do not upload content you do not have the right to share.

• No fraud, abuse of plan allowances, or attempts to bypass rental, exchange, or purchase rules enforced by the service.
• No interference with the site, other members' accounts, or our inventory systems.
• No use of the service for any unlawful purpose.

We may suspend or terminate accounts that violate these Terms, with rented aids due back immediately.

The service is provided "as is." Training aids are practice tools; we make no guarantee of any particular improvement to your golf game. To the maximum extent permitted by law, SwingRotation LLC's total liability arising from the service is limited to the amounts you paid us in the twelve months before the claim, and we are not liable for indirect or consequential damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in California, unless applicable law requires otherwise.

We may update these Terms from time to time. Material changes will be posted on this page with a new "last updated" date and, for account holders, notified by email where appropriate. Continued use after changes take effect constitutes acceptance.
